It is valid for a period of for 10 years from the date of application whereafter the trademark need to be renewed.

1. Common dictionary words cannot be register as trademark. For example Bed, Car etc. 2. Geographical location such as name of city / state/ country cannot be register as a trademark. 3. Name/Word having religious sentiments cannot be register as trademark. For example you cannot trademark name Ramayana, Lord Shiva. 4. Any cast name or surnames cannot be register as trademark. For example Brahmins. 5. Words which imply scandalous or obscene content cannot be register as trademark. 6. Words which are prohibited under the Emblems and Names (Prevention of Improper Use) Act cannot be register as trademark.
Trademark registration is territorial in nature. Thus, a mark registered in India will be valid only in India and not outside it.
1. ™ (TM)- This symbol signifies that the trademark application is under process and the proprietor can start using the said symbol immediately after the filing of application. 2. ® (R)- This symbol signifies that the trademark has been registered. 3. SM (SM)- This symbol is used for service marks.
Trademark Registration is tedious procedure and it takes time from 3 months to 18 months depends on objection or opposition being raised (if any). You will get TM symbol within 1 day of applying application.
A trademark, is a distinctive name, word, phrase, logo, symbol, design, image, or a combination of these elements or indicator used by an individual, business organization or other legal entity to be identified by its targeted consumers that the products or services on or with which the trademark appears to originate from a unique source, designated for a specific market, and to distinguish its products or services from those of other entities. 1. Productmark - Product Mark is a mark which is used for goods or products not for services. This type of mark is used to identify the product source and to distinguish products from others. Class 1-34 of trademark represents the products, so applications filed under this class can be termed as product Mark. 2. Service Mark - A service mark is same as a trademark, but instead of a particular product, it identifies and differentiates the source of a service. 3. Certification Mark - It is a sign indicating that the goods/services are certified by the owner of the sign in terms of origin, material, quality, accuracy or other characteristics. This differs from a standard trademark whose function is to distinguish the goods/services that originate from a single company. For example WOOLMARK, ISI etc. 4. Collective Mark - These are the trademarks used by a group of companies and can be protected by the group collectively. For example TATA SONS. 5. Sound Mark- A sound mark is a trademark where a particular sound does the function of uniquely identifying the origin of a product or a service. For example the jingle of the ICICI bank. 6. Shape Mark - Shape mark helps in distinguishing the goods sold by various manufacturers. It is used for the shape of goods and their packaging and customers find it relatable to a certain manufacturer. Registration can be done when shape and packaging of goods found distinctive. An example of Shape is the size of Toblerone Choclate, which have a distinctive shape identifiable with the brand.
Trademark Registry has classified Goods and services into 45 different classes. Every logo or brand name has to be registered under the relevant class. There are 34 classes for products out of 45 classes and 11 for services.
